9th Circuit Overturns Car Sleeping Ban

Today the US 9th Circuit Court of Appeals overturned the Los Angeles ban on homeless living in vehicles because it “opens the door to discriminatory enforcement” against the poor, according to a Los Angeles Times article published today after the hearing in San Francisco.

“I look forward to a full and detailed briefing from City Attorney Mike Feuer” wrote Councilman Mike Bonin when queried regarding this development. “Feuer has said he is willing to work with me and the City Council to craft a new ordinance that simultaneously protects the rights of homeless individuals and neighborhood quality-of-life. I am eager to work with him and find a way to strike that appropriate balance.

“We cannot criminalize homelessness, and we cannot allow virtual campgrounds to appear and proliferate in front of homes in residential neighborhoods in the coastal zone.”

This should in no way affect the 72-hour limit ordinance for any vehicle on the street. It should not affect the ordinances having time limits and those limiting the size of vehicles.
