VNC Asks to Be Part of “Shared Community” Group

Letter was sent to applicable City officials asking that Venice have a seat on forthcoming shared community work group and that Venice be considered as a large part of shared community analysis.

The shared community or short-term rental (STR) market grows in size in proportion to the beach proximity. But it is blossoming throughout Los Angeles, particularly near tourist attractions.

In Venice short-term rentals (STR) are illegal with the exception of property zoned commercial. Venice has no R-4 zoning which is the lowest in density to allow the short-term rentals. So unless property is zoned commercial, it is illegal. Yet, Venice residents or entrepreneurs operating STR businesses in Venice are subject to a 14 percent hotel tax. Some pay; some don’t. It is illegal but one must pay the tax!

It is big business and it is growing. Many claim that the short term market eliminates a neighborhood. It becomes a hotel, not a group of houses with long-term occupants, all of whom know each other. One has to ask himself: Would I want to live next door to a house that is used as a short-term rental?

Real estate brokers Tami Pardee and Denise Fast were queried regarding such. When selling a piece of property, one has to disclose any problems with the property. Both brokers were asked if a short term rental in close proximity had to be disclosed. Both said no

“No- that is not necessary unless there is a nuisance like barking dogs or loud noises,” messaged Tami Pardee.

Denise called and also said the problem would be noise.

So from this, one can decide for himself whether to disclose or not when selling. Is that short-term rental a party house that makes a lot of noise? It seems fortuitous in this age of litigious people, one would be wise to consider such

It has affected the rental market because owners want to make the big bucks, and in so doing, this has taken much of the normal rentals off the market. Supply and demand.

Re: Council File 14-0593 Sharing Economy-letter requesting focus on Venice as a distinct residential community/Venice community impact statement general comments

Dear Members of the Sharing Economy Work Group,
Please be advised that at a regularly held public meeting of the Venice Neighborhood Council (VNC) Board of Officers, on September 16, 2014, the following Motion was approved as part of the Consent Calendar by a 14-0-1 vote:

MOTION:
The VNC Board shall send a letter to the L.A. City Council Sharing Economy Work Group
recommending and making it very clear that the Venice Community deserves to be included in
preparing the Work Group’s report and recommendation to the City Council; and that the VNC Board recommends that as the L.A. community most severely negatively affected by short-term rentals that City Councilperson Mike Bonin strongly support us in having a seat at the table of the Work Group; and further, the VNC Board recommends that the CAO, CLA and other members of the Work Group focus on the positive and negative impacts of the recent exponential expansion of the short-term rental market on Venice as a distinct residential community of the City of L.A., and that they carefully research and analyze the impact of non owner-occupied short-term rentals on the availability of long term housing stock in Venice, the number of rent controlled units in Venice, and on the quality of life and socio-economic diversity in Venice’s residential neighborhoods (including commercial zones with rent-controlled properties).

White Line Rule Gets Crossed

Vendors are suppose to stay behind the white line in order to give responders ample room on Ocean Front Walk. They appear to be “movin on out.”

1511 Abbot Kinney Appeal Denied

Owners of 1511 Abbot Kinney will be able to provide “in-lieu” parking to comply with Venice Specific Plan. Land Use and Planning committee and Venice Neighborhood Council both disapproved of project. Planning approved it and Jim Murez, former member of LUPC appealed the decision.

Arts-in-residence use allows for special parking. Developers use this zoning to build or redevelop and then change the use. They pay the in-lieu fee of $18,000 per parking space, which is an inexpensive way of skirting parking requirements.

County Parking Fee Goes Up for Seniors

Seniors, at least 62 years old, can park on county parking areas and lots during the weekdays (Holidays excepted) with a $25-per-year permit obtainable from Beaches and Harbors.

The previous cost was minimal but the increase to $25 was authorized by the Board of Supervisors as part of a package of fee increases earlier this year.

“We have processed 3000 passes since 2013,” wrote Carol Baker Department of Beaches and Harbors Community and Marketing Division, and “prior to this, had no mechanism for cost recovery.”

The department has extended the parking privileges to include weekends until 9 am with the exception of holidays and excluding Grand Avenue, Washington Boulevard, Venice Boulevard, Rose Avenue, Will Rogers 1 and Surfrider parking lots. These lots are still available during the weekdays.

To obtain a pass one must present driver’s license and registration of vehicle with $25 (checks, cash, or credit card are accepted.). One can obtain such from Department of Beaches and Harbors, 13837 Fiji Way, Marina del Rey 90292, Monday thru Thursdays from 7 am to 6 pm. Vehicles over 20 feet are excluded.

Summer was great!.  Surf was special.   Crowds are leaving and so is the traffic.  Fall is on.

Water Conservation in Effect

Department of Water is stepping up enforcement of water conservation ordinance. Fines are $100 to $300 for residential and $200 to $600 for commercial. Phase 2 says one cannot do the following.

• Watering more than 3 days a week. Odd addresses may water with sprinklers Monday, Wednesday and Friday. Even addresses may water Tuesday, Thursday and Sunday. Absolutely no watering on Saturdays.
• Watering between the hours of 9 am and 4 pm.
• Watering more than 8 minutes per station.
• Watering of any hard surfaces such as sidewalks, walkways, driveways or parking areas, except for sanitary purposes.
• Outdoor watering during periods of rain.
• Allowing runoff onto streets and gutters from excessive watering.
• Allowing leaks from any pipe or fixture to go unrepaired.
• Washing vehicles without using a hose with a self-closing water shut-off nozzle.

It’s disturbing to hear that landlords who do not reside in Venice are converting their apartment buildings into Air B&Bs. This means Venice may no longer be a residential community. We will have less and less residents and more and more transient people. These people are not vested in the community. There is no sense of “community watch – know your neighbor – look out for your neighbor – neighborhood watch.” Add all the new and proposed restaurants with late night hours and liquor licenses, and you have one big unsupervised party for tourists and non-residents. This makes Venice a great target for theft and crime. Tourists and non-resident partying people under the influence of alcohol are easy desirable targets. This may result in many unforeseen consequences and much collateral damage. I’m glad to hear people will be studying the situation.

The Small Craft Harbor Commission is a legislative body in the Marina that the Board of Supervisors/developers now heavily control. While it is considered a citizen oversight board and solely advisory (one way the Board of Supervisors (BOS) has usurped its power), it rarely does anything. The mantra I use at almost every meeting is “Can we fix a swing?” – very symbolic question from one of the commissioners several years ago.

It took the Regional Planning Commission less than a second to consider the controversial Marina del Rey Visioning Plan that will guide the development in and around the harbor for the next 40 years. No questions, no comments, no deliberations, not one word by the commissioners. Approve and move. It is another example of “ceremonial acceptance” where the integrity of citizen oversight has been compromised. Attached is our 4 page report submitted to the Commission.
