Simmzy’s Determination & Coastal Commission Exemption Documents State …

Update got documents … the paper work at press time. Not the best time. Apparently, there was a restaurant there before the T-Shirt establishment and restaurant was the last legally permitted use.

Update thinks it was the original place for the Cheese and Olive restaurant and deli, owned by Nick the Greek, Nicholas Kokkinakis.

Many appeals have occurred as stated in Roxanne Brown’s article. Determination paper work does not record any renovation beyond a remodel. Was this a “Venice remodel” as Roxanne implies?

Zoning Administrator approved a Conditional Use to permit the sale and dispensing of beer and wine for on-site consumption, in conjunction with a proposed 1,560 square-foot· restaurant within the C4-1-0 Zone, with seating for 44 patrons indoors and 12 patrons on the patio, with hours of operation from 11 am to 11 pm Monday through Thursday, 11 am to 12 midnight Friday, 9 am to 12 midnight Saturday, 9 am to 11 pm Sunday, and opening at 9 am during five weekday special events per calendar year, subject to modified Conditions of Approval. Retractable windows and doors are to be opened no earlier than opening time and be closed by 9 pm Sunday thru Thursday and 10 pm Friday and Saturday.

Deliveries to the restaurant are to be made from Washington Boulevard with the vendors using the front door before the restaurant opens, and the back door after opening. Loading and unloading from the alley may occur only between 11 am and 5 pm, Monday through Friday, and 10 am to 5 pm on Saturday. All vendors making deliveries shall be made aware of these restrictions.

West LA Area Planning Commission denied an appeal to above 14 June 2013 decision. So above conditions stand and cannot find any other planning documents to refute the above conditions.

Coastal Commission Permit
Permit exemption from Coastal Commission states that “The proposed development is an interior modification to an existing use with no change in the density or intensity of use (Coastal Act Section 30106).” The following is from the Permit exemption.

“Project Description: Tenant improvements to an existing vacant restaurant building. There are a total of 43 restaurant seats, including 5 bar, 13 fixed and 25 additional non-fixed seats and a 10’1″ wide nonconforming loading zone in the rear. Improvements do not change the use or intensity of use of the restaurant site.

Please be advised that only the project described above is exempt from the permit requirements of the Coastal Act.”

Some Questions
Is the loading zone still there? Are there going to be only 43 seats? If one adds square footage to the building, does that disqualify “existing?”

APC to Hear Sauce Again

The Area Planning Commission will rehear, reconsider 259 Hampton, Venice appeal again 1 April, 4:30 pm at the Henry Medina Facility, 11214 Exposition Blvd, CA 90064. Ilana Marosi was the original appellant.

There will be an appeal reconsideration of 259 Hampton Drive at the West LA Planning Commission next Wednesday 1st April. The neighborhood won the first appeal of Jan 7th unanimously. The Applicant was granted a rehearing, so the community is back there to defend their appeal next Wednesday 1st April.

The community did a wonderful job to push back for the first successful appeal, with letters and testimony in person. They proved this development will be detrimental to the surrounding neighborhood and the Planning Commission concurred. Many voices together can make the right noise, and make a big difference in protecting quality of life for all Venetians.

Please turn up this Wednesday to show support for our community’s plight. This project will set a very bad precedent for the neighborhood if it is approved.

There will be a second-story bar 15 feet from neighbors’ homes with an open roof, operating until the early hours of morning. The NOISE disturbance of a bar in the midst of residential homes will be untenable for residents nearby. There is ZERO parking supplied, not even one disabled space. Cars will be crawling our streets in search of the Holy Grail of a parking space, and then add alcohol to the mix, more inebriated drivers will be a danger in our residential streets.

This corner is already extremely congested, and is a designated Coastal Access, which needs to be clear for emergency services, LAPD and LAFD. There are churches, a synagogue, childcare, pre-school all on that block, which is against the ABC recommendations. This census tract is 4-6 times over concentrated in its alcohol licenses and crime here is 3-4 times the citywide average. Please speak up to preserve peace and sanctity in our homes and our community! This one bad development could lead to many others, and before long you may have a bar in your backyard too! Enough is enough.

564-568 Rialto Avenue will be heard 16 March, 10 am, West LA Municipal Building, 1645 Corinth, LA 90025.

Owners want a permit to allow existing nonconforming side yard setbacks of 2 feet and 1-foot 6 inches on the east and west property lines, respectively, in lieu of the 5-foot side yard setback required and allow an existing nonconforming rear yard setback of 11- feet in lieu of the 15-foot rear yard setback. This is all in conjunction with the continued use and occupancy of two dwellings on two adjacent lots at 564 and 568 East Rialto Avenue in the RD1.5-1-O Zone and the proposed lot tie between the abovementioned lots.

Firestone to be Heard 26 March

Firestone Brewery, located at Lincoln and Washington in old World Gym facility, will be heard 26 March by Zoning Administrator at 10:30 am, West LA Miunicipal Building, 1645 Corinth, 90025.

Firestone Walker Brewery wants a Conditional Use Permit to authorize the sale and dispensing of beer and wine for on-site consumption and the sale, brewing, and dispensing of beer only for on- and off-site consumption. In addition, they want a Conditional Use Permit to authorize hours of operation from 11 am to 11 pm, Sunday through Thursday and 11 am to 12 midnight, Friday and Saturday, in the C2-1 Zone. All of this is in conjunction with a proposed 7,613 square-foot restaurant/retail/brewery (Firestone Walker Brewery) with 2,717 square feet of service floor area with seating for 187 patrons, and 4,580 square feet of office/retail, 987 square feet of which is designated retail space within existing improvements.

LUPC to Hear Four Cases Tonight

Land Use and Planning Committee will hear four cases tonight (3 March) from 7:30 pm at The Terrace Restaurant, 7 Washington Blvd.

Firestone Walker Brewery Company at 3205 – 3223 Washington Blvd will be heard by the zoning administrator 26 March, 10:30 am, West LA Municipal Building, 1645 Corinth Ave, LA 90025.

The applicant is seeking a beer and wine permit for on-site and off-site consumption. They want a conditional use permit to authorize hours of operation from 11 am to 11 pm Sunday thru Thursday and 11 am to midnight Friday and Saturday in conjunction with a proposed 7613 square-foot restaurant/retail/brewery with 2717 square feet of service area with seating for 187 patrons and 4580 square feet of office/retail with 987 square feet designated for retail space.

A two unit condominium project at 454 Venice Blvd will be heard 11 March at 9:30 am at Los Angeles City Hall, 200 North Spring Street, Room 1020, Los Angeles 909012.

Owner wants to construct two condominiums on R-3 zoned property.

3018 Neighborhood Outreach Has Few, But All Upset

The proposed L’olio restaurant at 3018 Washington Blvd neighborhood outreach had few people to attend but those who did voiced their opinions regarding no parking. Two even mentioned that there would be vermin, fan noise, and smells.

The architect said that 12 spaces were required. Three spaces were grandfathered, two spaces would be compensated with 8 bicycles, and the other seven required spaces would be paid for at $18,000 per space. Discount was mentioned for bikers and walkers.

One resident said she would be happy to pay $18,000 to assure her a place to park in front of her house.

One fellow who owned three restaurants and lived adjacent to property said he would fight this.
